One of Donald Trump's right-hand men, Steve Bannon, was convicted of two counts of criminal contempt of Congress, and was sentenced to four months in prison. Unfortunately, a Trump-appointed judge, Carl Nichols, let Bannon remain free pending appeal. A DC appeals court just affirmed Bannon's convictions and gave him seven days to seek review by all of the appellate court judges (which is very likely to be rejected). Bannon is now one giant step closer to prison. In a remarkable move, Trump-appointed judge Aileen Cannon vacated (cancelled) the May 20th trial date in Donald Trump's classified documents/obstruction of justice/espionage case in Florida and she announced that she'll be setting no trial date for the time being. This is particularly outrageous given that Trump's own lawyers had previously suggested an August trial date. Judge Cannon's conduct is reminiscent of some of the evidence in Trump's New York case: David Pecker, head of the National Enquirer tabloid magazine, was involved in a crooked scheme with Trump to catch and kill damaging stories about Trump to help him in the 2016 election. Now, it sure looks like Judge Cannon is catching and killing Trump's Florida case, which undoubtedly will help him in the 2024 presidential election. Regarding Judge Cannon's pro-Trump bias, the recusal cup runneth over. Judge Juan Merchan, the New York State court judge presiding over Donald Trump's criminal trial for interfering in the 2016 presidential election, found Trump guilty of a 10th count of criminal contempt of court for violating his gag order again. But once again, Judge Merchan only imposed a punishment of a $1000 fine. He also again warned Trump that, in the event he continues to violate the court's order, he could be jailed, "if necessary." It's not often that a presiding judge publicly calls out a defendant for lying outside the courtroom. Yet, that is precisely what New York State court judge Juan Merchan found himself having to do when Donald Trump claimed that a gag order prohibited him from testifying in his own defense at trial. Donald Trump is indicted on 88 felony counts, across four jurisdictions, for crimes he committed - many of them while he was serving as president. Trump's lawyer, John Sauer, argued before the U.S. Supreme Court that Trump shouldn't be prosecuted for the crimes that were committed while he was in office. Specifically, Sauer said that the following acts are official presidential acts that would be covered by presidential immunity: ordering the assassination of a political rival; ordering the military to stage a coup to keep the president in power after he lost an election; and selling our nation's nuclear secrets to a foreign adversary. Judge Juan Merchan is about to decide if Donald Trump is guilty of criminal contempt for violating the court's gag order at his election interference trial in New York. Assuming he holds Trump in contempt, that will represent a violation of Trump's conditions of pretrial release in his criminal cases. Why is this dire for Trump? Judge's have told him: one of the conditions he must obey while on release is that he not commit any new state, federal, or local offenses because if he does he can be revoked on pretrial release. The consequences of being found in criminal contempt may end up being even more damaging for Trump then he realizes - much more than the $1000 per violation money fines and 30 day per violation jail terms that he is now facing in Judge Merchan's court in New York. Day two of his criminal trial was no better for Donald Trump than day one. His friend and long-time associate David Pecker testified about the dirty "catch-and-kill" scheme they conspired to execute to assist Trump in his political pursuits. Pecker also testified that Trump was very detail-oriented, to the point of being a "micromanager." This directly undercut Trump's lawyer's contention during opening statements that Trump had no idea why he was writing multiple $30,000 checks (totaling $420,000 in all) on his personal checking account and delivering the checks to Michael Cohen. In essence, defense lawyer Todd Blanche was urging the jury to check their common sense at the courtroom door. Even worse for Blanche, at one point during the criminal contempt argument for Trump's repeated violation of his gag order, Judge Merchan told Blanche, "you're losing all credibility with the court". Given that the penalty for criminal contempt is up to 30 days in jail per violation, there is a very real possibility that Trump could end up in jail. Indeed, The New York Times reported that the United States Secret Service and other law enforcement agencies have been meeting to determine how they would handle Trump's incarceration if he is ordered jailed. Donald Trump has violated the gag order imposed by Judge Merchan in his New York criminal prosecution. Trump has repeatedly violated the gag order - talking about and endangering the witnesses in the case. Criminal trials can often be a bit like popularity contests. Each attorney will strive to be liked, trusted, and respected by the jury. In a sense, each attorney will want to be the most popular in the eyes of the jury. But more importantly - how does the jury views the defendant? Does the defendant come across as likeable, trustworthy, or honorable? There's one important piece of evidence that was disclosed a year ago in the Statement of Facts that accompanied the Indictment in Trump's 2016 Election Interference Case. This evidence will make him the most unpopular person in the entire courtroom. In fact, this one piece of evidence could very well lead the jury to convict Trump in a New York minute. If it already wasn't crystal clear that Trump-appointed Judge Aileen Cannon should be removed from presiding over the prosecution of the very defendant who bestowed upon her a lifetime appointment as a federal judge, it is now beyond reasonable dispute. Judge Cannon ruled AGAINST Trump, denying his motion to dismiss the 32 espionage counts in his Florida federal prosecution, yet Trump then praised her and attacked Special Counsel Jack Smith for telling her - in a court filing - that she was wrong. It's been a really bad couple of days for two Trump-affiliated lawyers, John Eastman and Jeffrey Clark. After a bar counsel ethics trial, a California judge ruled that John Eastman - one of the architects of the fake elector scheme - should be disbarred, saying that his "actions were carried out with deceit or dishonesty" and his plan to derail Joe Biden's election victory "was unlawful and lacked any factual or legal support." Former DOJ official Jeffrey Clark is contending with his own disbarment hearing in Washington, DC. When given the opportunity to testify in the hearing Clark repeatedly pleaded the 5th - invoking his 5th Amendment right against self-incrimination. Donald Trump is sending his lawyers from one New York courtroom to another, making them repeatedly ask judges to reduce the amount he must put up to appeal his massive losses in both the E. Jean Carroll case and his NY fraud case. Judge Kaplan and Judge Engoron have both told Trump's lawyers they won't reduce the amount. The United States Supreme Court has dealt American democracy a gut-punch, ruling that state election authorities CANNOT keep an insurrectionist off the state presidential primary ballot... even after a state trial court and State Supreme Court ruled that a person HAD engaged in insurrection against the U. In a move that again highlights why Judge Aileen Cannon should be recused from presiding over Donald Trump's federal prosecution in Florida, she refused to set a trial date during a hearing on Friday. This is inexplicable given that Jack Smith proposed a trial date of July 8th and Trump's lawyers proposed one for August 12th. This prompted Jack Smith's prosecutor to tell Judge Cannon that the one thing the parties seem to agree on is that there can be a summer trial date - which would at least get the case tried before the November presidential election. But Judge Cannon said she was "skeptical" of the case being ready to be tried this summer, even though Trump's lawyers said they could do it. The federal law requires that a judge "shall" recuse themself from presiding over a case "if their impartiality might reasonably be questioned." In a stunning development, the Supreme Court not only decides to take up on appeal Donald Trump's absurd, baseless presidential immunity claim, but they won't even hear oral arguments in the case for nearly two months. And it could take them weeks or months thereafter to decide the case, making it unlikely that Trump's trial for trying to overturn the results of the last presidential election will take place before the next presidential election. The DC federal circuit court of appeals has unanimously ruled that Trump is not immune from prosecution for his January 6th crimes. In their opinion - the court pointed out the Constitution expressly states that presidents can be criminally prosecuted EVEN IF they're first impeached. The Constitution also imposes a duty upon presidents to "faithfully execute the laws" of our nation. In other words - the very language of the Constitution makes clear that presidents ARE NOT immune from prosecution for crimes they committed while in office. Before dismissing the jury at the conclusion of the E. Jean Carroll defamation trial and just after they awarded Ms. Carroll $83.3 million for Trump's incessant defamation - Judge Lewis Kaplan told the jurors that he recommends they tell NO ONE that they served on the Trump jury. Trump endangers everyone who is involved in holding him accountable for his crimes and his civil wrongs. This includes witnesses; judges and their staff; prosecutors and their family members; and jurors. Trump is on pretrial release in four felony cases, both state and federal. The law provides that if someone is on release in a felony case, and there is clear and convincing evidence that the defendant poses a danger to even one person in the community, that person should be detained pending trial. Yet instead of doing what the law provides, the institutions of government have decided that every single person involved in the endeavor of holding Trump accountable should alter their lives rather than neutralize the threat by detaining Trump pending trial. A New York jury has issued its verdict in the second defamation case that E. Jean Carroll bought against Donald Trump: Trump must pay Ms. Carroll $83.3 million in compensatory and punitive damages. A year earlier, a jury awarded Ms. Carroll $5 million due to Trump defaming her on other occasions. Moreover, during closing arguments, Trump disrupted the proceedings by storming out when Ms. Carroll's lawyer told the jury that Trump acts like the rules don't apply to him. Of course, Trump's disruptive behavior directly and dramatically proved the exact point Ms. Carroll's attorney was arguing to the jury. Glenn says Donald Trump truly is the biggest loser when it comes to his court cases. He's lost both trials against E. Jean Carroll. He's lost his New York civil fraud trial, and we are simply awaiting Judge Engoron's decision regarding how much Trump will have to pay (or "disgorge"). Today was not a particularly good day for justice. Although Peter Navarro was sentenced to four months in prison for contempt of Congress, the judge DID NOT order him to be taken into custody. This is reminiscent of Steve Bannon, who was also sentenced - back in October 2022 - to four months in prison for contempt of Congress, but has yet to to serve a single day of his sentence. Perhaps worst of all, Donald Trump took the stand today in his defamation trial in New York and, after Judge Kaplan told Trump he was prohibited from calling E. Jean Carroll a liar, Trump IMMEDIATELY called E. Jean Carroll a liar. Yet there was no sanction, no accountability, and no contempt finding. No one can accuse Donald Trump of being a strategic thinker. Donald Trump is as transparent as child when it comes to what he tries to accomplish with his lies, his disinformation, and his propaganda. For example, when he posts lies like, "the prosecutors are not coming after me, they're coming after you," it's a rallying cry designed to dupe his followers into feeling like they have a personal stake in the Trump prosecutions. Of course, the reality is that it is Trump, not his supporters, who is facing 91 felony charges in four cases, both state and federal. In his recent post, Trump tipped his hand, making it clear that even he knows that he will be convicted at trial. Glenn explains how Trump is now softening the ground in hopes he can dupe his followers into believing that the coming convictions will not be legitimate. Then, Glenn discusses Trump's criminal defense attorneys who seem to again be taking on the tone and tenor of their client in legal filings. Their latest motion is no exception. Trump's lawyers have asked Judge Tanya Chutkan to hold Jack Smith and his prosecutors in contempt for giving the defense discovery (evidence) and filing a motion while the case is on appeal. But they don't stop there. We've seen this movie before: some government official, some prosecutor, some law enforcement agent does something to hold Donald Trump accountable for his crimes, and Trump posts things about the person designed to inspire his supporters to threats and violence against that person. Most recently, Maine Secretary of State Shenna Bellows followed Maine's elections laws and her oath of office, and disqualified Trump from the Maine ballot. So, of course, Trump posted Secretary Bellows' bio and the threats started pouring in. Trump is on pretrial release in four felony cases. The law provides that, when there is clear and convincing evidence that a person under felony indictment poses a threat to the community or any person in the community, that defendant is to be detained pending trial. Glenn says it's long past time that the institutions of government apply the nation's pretrial detention laws to Trump as those laws are applied to every other person who is pending trial in a felony case. As the 50 states continue to decide the question of whether Donald Trump should be disqualified from state election ballots pursuant to the 14th Amendment because he engaged in insurrection against the United States, it looks like one conservative Supreme Court Justice ruled on that issue previously. In the ruling handed down by the Colorado Supreme Court disqualifying Trump from the presidential ballot in Colorado, the court relied on a legal opinion authored by Neil Gorsuch when he was a federal appellate court judge. The issue was whether the states had the authority to ban from their election ballots a candidate who was disqualified under the Constitution. Here are the precise words of then-Judge (now Supreme Court Justice) Neil Gorsuch: "a state's legitimate interest in protecting the integrity and practical functioning of the political process permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office. " Glenn says: So the only question left is - will Gorsuch remain consistent with his prior ruling and allow Colorado and the other states to disqualify Trump from their state ballots? Then, Donald Trump has asked the DC Circuit Court of Appeals to rule that he is above the law - absolutely immune from being prosecuted for the crimes he committed while in office. The Michigan Supreme Court has refused to review a case that sought to ban Donald Trump from having his name placed on the Republican primary ballot in Michigan. This ruling is unsurprising given the unique election laws and procedures in Michigan. If the Michigan Republican Party wants to place a name on its presidential primary ballot, it can put any name it likes, including someone who may otherwise be disqualified from holding public office. That may make little sense, but each state has the right to enact its own election laws and regulations, and Michigan has chose a . . . curious way to go about things. Notably, the Michigan Secretary of State has no legal authority to reject Trump's name even though he engaged in an insurrection. So the Michigan Supreme Court opted to not review the case, as it involved no violation of Michigan election laws. However, if Trump were to win the Republican nomination, the suit will be refiled and the court may then HAVE to review and resolve the case. Indeed, the attorney who brought the case on behalf of the Michigan voters has said he will refile the case if Trump ends up being the Republican nominee.
