Partner Catherine Allen delivered a keynote session on the topic of ‘Good Governance: Setting up and Preparing for Healthcare Investigations’. Healthcare organisations often need to set up investigations, both internal and external, and from time to time must participate in other types of investigations. These include statutory public inquiries, non-statutory public inquiries, investigations, and reviews. The process of setting up, conducting, and participating in these investigations often leads to various governance issues, including data privacy issues, terms and conditions of appointment of investigators and reporting obligations. Catherine gave a brief overview of some of these issues to help guide good governance in these areas.

We hosted our fourth annual Commercial Contracts: What’s Market? on Wednesday 10 May. Following on from the success of our 2020, 2021 and 2022 webinars on contract negotiation, market practice and what would be considered off-market, we are pleased to launch our 2023 survey of Irish and international in-house counsel. During the session, our speakers outlined our experience of “what’s market” on key contract clauses in areas such as liability caps, indemnities, ESG compliance, use of AI and more. We presented data from our own database of negotiated client agreements, as well as shared the results of the in-house counsel survey on these issues. We discussed the current legal position on these common contracting issues and gave key take-aways to assist with negotiating commercial contracts. We hosted our second Employment Law Top Tips session of the year where we looked at How to Conduct an Effective Workplace Investigation. We were delighted to be joined by Clara O’Sullivan, Founder of COSWI (Clara O’Sullivan Workplace Investigations). Clara is a solicitor and internationally accredited Workplace Investigator from the Association of Workplace Investigators (AWI) in California. Clara shared some practical tips on how to conduct investigations for all workplace matters whether they relate to grievances, disciplinary or bullying and harassment issues. On Thursday 13 October we hosted a webinar on Financial Regulation: Prepare for the SEARing Heat. With the publication of the Central Bank (Individual Accountability Framework) Bill 2022, the scope for personal exposure and director/manager liability within Irish regulated financial firms will expand dramatically. At this webinar we explored this topic and help you prepare for Ireland’s senior executive accountability regime (SEAR). Our panel of MHC experts discussed the impact of the Bill and of implementation of SEAR, focusing on the personal impacts for individual directors and managers. We were delighted to also be joined by Chris Finney, a partner at Fox Williams in London and a specialist in representing senior managers under investigation by the UK Financial Conduct Authority, who gave us an overview of the UK experience in this area.
