Massimo Coccia is founding partner of Coccia De Angelis & Associati law firm. He holds a J.D. degree cum laude from the Law School of the University of Rome Sapienza (1981) and a Master of Laws degree (LL.M.) from the University of Michigan Law School (1984), which he attended with a Fulbright fellowship. It is universally recognized that Mr. Coccia has an extensive experience of, and is an authority in, sports law and in commercial arbitration at international and national level, both as an arbitrator and as a counsel. He has been involved in almost 400 arbitration proceedings (mostly international). He also has been frequently involved in regulatory matters such as antitrust and energy, as well as in entertainment law issues. He is frequently retained as legal advisor or counsel by international and national federations, leagues, clubs, teams, agents and athletes of various sports. Within football, in particular, Mr. Coccia was appointed as the Interim Vice-Commissioner of the Italian Football Federation (FIGC) in 2006-2007, in the wake of a match-fixing scandal and authored important reforms of the rules and governance of FIGC. Since 1995, Massimo Coccia has been an arbitrator at the Court of Arbitration for Sport (CAS), where he is regarded as one of the most experienced arbitrators, having sat in about 300 cases and drafted many prominent awards, having also been a CAS arbitrator at the Olympic Games of Salt Lake City 2002, Turin 2006 and London 2012. Massimo Coccia is also a tenured law professor, teaching International Law at the Tuscia University of Viterbo as well as European Competition Law at the University of Rome Sapienza. Massimo also frequently teaches in graduate courses and seminars on international and national sports law. He has published extensively on issues of sports law, international arbitration, international trade law and EU law, and is often invited to speak at symposia on those subjects. Paolo currently assists a significant number of clubs in the Italian Serie A, as well as providing advice to Lega Serie A and a number of clubs in Scotland and England, and internationally. The area of focus being transfers, dispute resolution, breach of contract, training compensation and solidarity mechanism, registration of minors and more. In addition, he also assists clubs with both UEFA and national licensing issues, including proceedings before CAS. Paolo has been involved in a number of cases which have shaped the jurisprudence of CAS. Lombardi Associates has now been in active in the market for over 10 years. Prior to Lombardi Associates, Paolo worked at FIFA joining the FIFA Players’ Status Department in 2002, becoming Deputy Head in 2006. He was responsible for players’ agents and involved in landmark cases, including Mexes, Webster, Mutu. In 2007 he was appointed Head of FIFA Disciplinary and Governance, overseeing disciplinary and governance matters both in-house and at various FIFA tournaments such as the Beijing Olympics and the 2010 FIFA World Cup in South Africa. Caroline McGrory is the Chief Legal Officer for the Birmingham 2022 Commonwealth Games. She started off her career in private practice before moving in house to IMG (the global sports marketing agency) in 2000. She then moved back into private practice to become the inaugural Head of the Sports Group at Charles Russell Speechlys LLP (then Charles Russell). After this, Caroline joined what was then B.A.R (British American Racing) as Legal Director and as a member of the senior management team. Caroline was part of the Management team who undertook a buy out of the team from Honda in 2009 to create Brawn GP which went on to win both the Constructors’ and Drivers’ World Championships in that year (whilst she was a shareholder and director of the team). The team was purchased by Daimler in 2010 and competes as the Mercedes AMG PETRONAS F1 Team. Caroline’s role at Mercedes expanded beyond a pure legal role when she became the Director of Legal and Commercial Affairs. She however continued to manage all legal aspects of the successful operation of a Formula One team, including negotiating drivers’ contracts, sponsorship and regulatory matters. In December 2016 Caroline took the leap into football to undertake a new challenge, having been in Formula One for 13 years, when she joined Leicester City Football Club as their first General Counsel before moving on to the Birmingham 2022 Commonwealth Games. In 2020, Azeem Rafiq publicly spoke about the alleged racism faced at him while he played for the Yorkshire Country Cricket Club (YCCC) between 2008-2014 and 2016-2018. Eventually, YCCC launched its own investigation and Rafiq also appeared before a UK Parliamentary Committee to elaborate on his allegations against the club. In November 2021, two partners at DLA Piper of South Asian descent sat down to discuss their own personal and professional reflections of the recent Azeem Rafiq testimony, together with practical guidance on how to create inclusive workplaces. We sat down with Sohail Ali and Gurpreet Duhra to talk through more around their personal experiences of discrimination in both sport and in law in the UK along with their professional experience for both athletes and sports organisations on dealing with discrimination. Sohail Ali is a partner at DLA Piper and is also a LawInSport Editorial Board Member. He was a Justice of the Supreme Court of the United Kingdom from April 2010 until October 2012. Over his career Lord Dyson has been involved in many high profile sports cases, some resulting in the establishment of the Premier League and the introduction of all-seater football stadiums in the UK. More recently he has adjudicated the Peter Beardsley racism case for The FA and the Saracens Salary Cap case for Premiership Rugby. In this interview Lord Dyson givens a detailed insight into his career and shares his thoughts on the state of sports dispute resolution as well what it takes to achieve a magnificent career in law. He recently published his memoir ‘John Dyson - A Judge's Journey’, which I recommend reading. It is available at all good bookstores and online. All the proceeds going to charity. Lord Dyson biography Lord Dyson was Master of the Rolls (President of the Court of Appeal of England and Wales and Head of Civil Justice) for four years until he retired in October 2016. He was a Justice of the Supreme Court of the United Kingdom from April 2010 until October 2012. He was a Lord Justice of the Court of Appeal of England and Wales from 2001 until 2010 (and Deputy Head of Civil Justice from 2003 until 2006). He was a Judge of the High Court of England and Wales from 1993 until 2001, and the Judge in charge of the Technology and Construction Court from 1998 until 2001. He was a Recorder from 1986 until 1993. Lord Dyson was called to the Bar by the Middle Temple in 1968 and was awarded a Harmsworth Scholarship. He was Treasurer of the Inn in 2017. From 1968, he practised in Keating Chambers and was appointed QC in 1982. In 1986 he accepted an invitation by 39 Essex Chambers to become Head of Chambers, a position he held until 1993 when he was appointed to the High Court. Since retiring from the Bench he has been accepting appointments as an arbitrator and mediator in both domestic and international arbitrations. He has lectured extensively on a wide range of subjects in the UK and abroad, including in Hong Kong, Singapore, Malaysia, US, Australia and New Zealand. He has given lectures to the Chartered Institute of Arbitrators on mediation and arbitration. He gave the Mustill lecture in 2013 on Arbitration and the Brussels 1 Reform. He has participated in legal exchanges with judges and lawyers from other jurisdictions, such as US, Canada, Singapore, Hong Kong, South Africa, Israel, France and judges of the Court of Justice of the European Union and has contributed papers on these occasions. He is an Honorary Fellow of Wadham College, Oxford, the Institute of Advanced Legal Studies and the Hebrew University, Jerusalem. He is a Visiting Professor at Queen Mary, London and University College, London. He has honorary doctorates from University College, London and the Universities of Leeds and Essex. He is a member of the Court of Arbitration for Sport (CAS), the Sport Resolutions Arbitration Panel, The Football Association’s Judicial Panel, LCIA and ICC. In this podcast Sean Cottrell, LawInSport CEO, interviews Günter Younger the Director of Intelligence and Investigations for the World Anti-Doping Agency (WADA) about his role, the work of his department, working with whistleblowers and the challenges of running investigations in international sport and anti-doping. Mr. Younger was previously Head of the Cybercrime Division at the Bavarian Landeskriminalamt (BLKA) in Germany, which he created as the central point of contact for police, State departments and private companies in all cybercrime matters of Bavaria. While fulfilling this role, in 2015, Günter was seconded to WADA’s three-person Independent Commission that investigated and exposed widespread doping in Russian athletics. After graduating from Police Training School in Dachau and Kӧnigsbrunn in 1988, Mr. Younger joined the BLKA as an investigator. Over the years, Günter held numerous increasingly senior positions with a particular focus on international investigations; specifically, combating drug trafficking and organised crime. After completing postgraduate studies at the Police College of Public Administration in Fürstenfeldbruck and at the National Police Staff College in Münster, Mr. Younger served as Deputy Head of the Organised Crime Division of the BLKA. In 2006, he was deployed to Europol as an Analyst for Serious Organised Crime. In 2008, Mr. Younger was seconded to Interpol´s drug unit in Lyon/France where he was swiftly promoted to Team Leader/Coordinator. By the following year, he had assumed responsibility for the organization’s Drugs and Criminal Intelligence Unit (DCIU) and the newly created Anti-Doping section. Upon completion of his term at Interpol, in 2011, Mr. Younger returned to Germany to lead Bavaria’s Counterfeit Currency Unit before joining BLKA. Dr Kelsey Erickson (@kelslee777 ) is a Research Fellow at Leeds Beckett University. Her primary research interest is the social psychology of doping in sport. Her PhD research was titled "Doping in Sport: a cross-national (US and UK) analysis of track and field athletes". In this podcast Dr Erickson talks about the psychology of doping and about her research on global whistleblowing programs in sport. Kelsey's principal research interest is doping in sport. Her doctoral studies were completed in January 2016 and were assisted by the financial support of the International Athletic Foundation (IAF). The program of study adopted a holistic approach to explore the lived experiences of track and field athletes; thus, documenting the relational aspects of doping for the first time. During her studies, Kelsey simultaneously worked on projects commissioned by the World Anti-Doping Agency (WADA), as well as providing assistance on multiple research studies funded by various organisations (e.g. UK Anti-Doping Agency, UK Military of Defense). Research Interests With the financial support of the International Olympic Committee (IOC), Kelsey's current research is focused on designing, piloting and evaluating an anti-doping education program for student-athletes in the US, UK and Canada. This follows the World Players Association publication of the Universal Declaration of Player Rights, which is the first comprehensive articulation of athletes’ rights, sets a benchmark for international sporting organisations to meet their obligations to protect, respect and guarantee the fundamental rights of players. “The rule books of world sport impose thousands of pages of onerous obligations, but none clearly spell out the internationally recognised human rights of athletes,” said Brendan Schwab, Executive Director of the World Players Association. “The result is an unjust system of sports law that lacks legitimacy and fails to protect the very people who sit at the heart of sport. We are making it clear that athlete rights can no longer be ignored. They must be able to quickly access justice.” The implementation of the principles set out in the Declaration will introduce long overdue reforms to the governance of sport. Some examples include: Every player is entitled to equality of opportunity in the pursuit of sport without distinction of any kind and free of discrimination, harassment and violence. Every player has the right to freedom of opinion and expression. The rights of every child athlete must be protected. Every player has the right to share fairly in the economic activity and wealth of his or her sport which players have helped generate, underpinned by fair and just pay and working conditions. Every player has the right to organise and collectively bargain. Every player is entitled to have his or her name, image and performance protected. A player’s name, image and performance may only be commercially utilised with his or her consent, voluntarily given. Every player has the right to a private life, privacy and protection in relation to the collection, storage and transfer of personal data. Every player must be able to access an effective remedy when his or her human rights are not respected and upheld. This is particularly crucial given the highly skilled yet short term and precarious nature of the athletic career. The Declaration was developed over the last two years by the more than 100 player associations affiliated to World Players. It has also undergone a thorough review process by human and labour rights experts. It reflects generations of organised players’ experiences and incorporates recent feedback from thousands of players provided through wide-ranging surveys conducted by player associations. It is also firmly anchored in international human rights law and core International Labour Organisation standards. Whilst the agreement is an expansion of Football DataCo’s existing integrity monitoring provision, launched in 2014 with Genius Sports. The Genius Sports and Perform partnership is the first time that two global leaders in sports data and technology have joined forces to collaboratively protect the integrity of sport against match-fixing. This new partnership will see all parties working together to develop a bespoke intelligence network, capitalising on Perform Group’s and Genius Sports’ extensive industry expertise and resources. This will facilitate the development of a unique intelligence database and analytical capability that will provide Football DataCo, the Leagues and the Football Association with greater visibility and protection against threats to their integrity of their competitions. This combined technology will monitor all odds movements across 14 different competitions in English and Scottish football. This includes not just the core Premier League, EFL, and Scottish Professional Football League matches but also the English and Scottish FA Cups and steps 1-4 in the English National League. Jonathan is co-head of Bird & Bird's Sport Group, based in London. He advises a wide range of sports bodies (including international and national governing bodies, public agencies, event organisers, leagues, clubs, and their commercial partners and agents) on commercial matters such as the exploitation of broadcasting and sponsorship rights, contentious matters including challenges to regulatory decisions, commercial disputes, and regulatory and disciplinary issues (including in particular match-sanctioning, match-fixing and doping issues). Jonathan is an experienced advocate, appearing regularly before the Court of Arbitration for Sport in Lausanne, as well as a range of internal sports tribunals. In recognition of his skills as an advocate, he was appointed Queen’s Counsel in 2017. In 2016, Jonathan chaired the WADA Independent Observer team that served at the 2016 Rio Olympics, and in December 2016 he was appointed chair of WADA’s Compliance Review Committee. Jon sits as an arbitrator in sports disputes (as chairman of the International Baseball Federation’s Anti-Doping Panel, under FA Rule K, and as a member of the Panel of Arbitrators of Sport Resolutions), and is also a member of the British Horseracing Authority’s Ethics Committee and the World Anti-Doping Agency’s Working Group on Legal Matters. Holding both UK and US law degrees, Jonathan originally qualified and practised as a commercial lawyer in New York, before moving back to the UK in 1997, since he has since focused exclusively on advising sports sector clients. Alongside his practice, Jonathan is co-editor (with Adam Lewis QC) of the leading UK sports law text, Sport: Law and Practice (3rd Edn 2014). He was a tutor at University College, Oxford (Tort Law and Administrative Law) in 1992/93 and Director of Studies in Sports Law at King's College, London from 2000 to 2007. Life after sport can be a hurdle for athletes. Many athletes disconnect from the sports world entirely, while others may feel a sort of identity loss.
