What if you’re going to sell a property you inherited but it’s still in the name of your parents? How should you settle the estates of a deceased married couple? Where should you pay the estate tax for each of them?  A lot of the properties we help buy or sell, are usually inherited properties that are still in the name of the parents, grandparents, or even siblings of grandparents. And the big problem here which complicates the sale is that all their estates have not yet been settled. This is the question of one of our viewers, Anthony and he writes:    “Property is located in QC with both names under mother and father.  Mother died in the province as indicated in the death cert. Father died in QC as indicated in death cert. My father died a few years after my mother. Will the estate tax be settled 50% in the province and 50% in QC?”  If you’re having issues transferring your land or have issues transferring the properties of a loved one who passed away, we have something that can help. We all know that our Constitution currently prohibits foreigners from owning land in the Philippines. But does this apply to Filipinos, who became citizens of another country?   

A lot of our countrymen who worked abroad for many years want to eventually retire back here in the motherland.  But what if they’ve already gained citizenship in that other country? Can they still come back to the Philippines and own property?   This is the question of one of our viewers, Bobby E and he writes:

What are the roles of the people in the barangay?

When you leave the house, the first officials you'll see are from the barangay.

Tanods are included because they're the frontliners when it comes to government units. But not a lot of people understand.

What are the jobs of different people in the barangay? And, if ever you don't understand what their jobs are, how will you vote correctly?

Did somebody give you 1 share or 1% share in a corporation just because they needed to complete the minimum number of shareholders? 

We see this a lot in family corporations and businesses. Stockholders whose names are placed in the corporation as owners, when in fact they don’t have any investment in the corporation…or they’re not even involved in the corporation at all.  

Many times we find that the owners of a corporation include the names of the owner’s children.  Sometimes you will even see secretaries, drivers, or even household helpers named as part owners of the company.

So, how many of you have family properties that are still in the name of your grandparents... Or, worse, how about great grandparents? Yeah.

"Attorney, my mom, and her siblings inherited property from our disease lolo sometime in 2001.

It was our ancestral home, located in a town center. They didn't do anything to transfer the title to them. They recently decided to sell the property and got a very good offer.

We found out that we still need to pay estate taxes from when my lolo died.

This is potentially very big since he died in 2001. Is there any way to get a discount or some consideration from the tax?

My mom is currently living in the US and had no idea that this needed to be paid at the time. It seems unfair that we will now have to pay for this. Is there something that we can bring or ask the BIR to do to get any discounts or deductions?"

A loved one has just died.  There are properties left behind. Do you have any idea how to get started?
