The defendant charged with plotting a Trump assassination, Ryan Routh, filed a motion to have Cannon recuse herself from his case given that Trump is the victim. House Speaker Mike Johnson has confirmed to The New York Times that he and Donald Trump have a "little secret" designed to help Trump take power regardless of the election's results. Recall - Trump had not just one but FIVE little secret plans to steal the 2020 election: 1. A little secret plan to have his dirty lawyers file more than 60 fraudulent lawsuits to try to steal the election 2. Donald Trump held a hate rally at Madison Square Garden Sunday night. After Florida Governor Ron DeSantis and his Republican legislators banned abortion in Florida after 6 weeks (at which point most women may not even know they're pregnant), 900,000 Floridians signed a petition to get abortion rights on the ballot as a constitutional amendment, designated as Amendment 4. A pro-choice group called Floridians Protecting Freedom created a TV ad supporting Amendment 4. The commercial plainly and inarguably constituted political speech protected by the First Amendment. Nevertheless, DeSantis and his henchmen issued cease and desist letters to 50 TV stations, threatening them with prosecution if they aired the pro-Amendment 4 commercial. Floridians Protecting Freedom filed suit in federal court seeking a restraining order prohibiting the state of Florida from violating their free speech rights. A federal judge granted the request for a restraining order, pointedly informing DeSantis of the following in his written ruling - " Too keep it simple for the State of Florida: it's the First Amendment, stupid." Recent reporting makes clear that Donald Trump is proudly and enthusiastically lawless. First, he announced that if elected he will fire Special Counsel Jack Smith - the very prosecutor who is pursuing Trump in two federal criminal cases - adding that he will fire him "within two seconds" of taking office. Of course, a president can't fire a special counsel, only an Attorney General can. Someone should tell Donald Trump "You know, you have the right to NOT incriminate yourself." In a recent town hall campaign event, Trump repeatedly said "We did not have guns (at the US Capitol) on January 6th". By choosing to describe the insurrectionists using the personal plural pronoun "we", Trump directly aligned himself with the folks who attacked the Capitol on Jan. 6th, there by incriminating himself (as he so often does). Interestingly, that statement is actually an incriminating twofer, given that Trump lied about his angry mob not being armed with firearms on January 6th. Trump was briefed on the morning of January 6th that members of the crowd WERE armed with firearms, to which Trump responded, "I don't care if they are armed, take down the fucking mags (metal detectors), and let my people in, they're not here to hurt me, then we can all march to the Capitol from here." Once Trump's cases move from the court of public opinion into courtrooms proper, Trump will be convicted in case after case after case. Lucas Kunce is running for the Senate from Missouri against "The Running Man" himself, Josh Hawley. The Supreme Court returned Trump's criminal case to DC Federal Court Judge Tanya Chutkan directing her to hold hearings to determine which of Trump's January 6th crimes involved official presidential acts and which did not. Trump's lawyers have filed a 34-page brief demanding that Judge Chutkan "dismiss" Trump's case "promptly." As we all know, Judge Aileen Cannon - who was appointed to the federal bench by Donald Trump - ruled that Special Counsel appointments are not lawful and she dismissed Trump's federal classified documents/obstruction of justice/espionage case. In a surprising plot twist, Hunter Biden's lawyers pointed to Judge Cannon's decision and tried to use it to convince another federal judge - Judge Mark Scarsi (who was also appointed by Trump) to dismiss the federal tax case pending against Hunter Biden. Trump-appointed judge Aileen Cannon continues to wear her Trump favoritism on her sleeve. A number of motions filed by Jack Smith have languished, remaining unresolved for months. As but one example, back in May, Smith filed a motion asking Judge Cannon to modify Trump's conditions of release to stop him from lying about and endangering FBI agents. Cannon has sat on that motion. However, Trump filed a motion asking Cannon to stay or pause a number of deadlines in his Florida case while he briefs-up issues regarding presidential immunity. Judge Cannon acted on Trump's motion IN LESS THAN 24 HOURS, ruling in his favor and giving him precisely what he wants. As has long been the case, Cannon's "impartiality might reasonably be questioned," which is the federal legal standard requiring her disqualification from the case. But, of course, she will ignore the federal law and continue to preside over the prosecution of the very defendant who gave her her lifetime appointment to the federal bench. The Supreme Court didn't JUST rule that presidents have absolute presidential immunity. They actually ruled that presidents have absolute presidential immunity PLUS. Constitutional scholars left, right, and center are excoriating the new Supreme Court opinion that 1. contradicts the expressed language of our constitution, 2. actually repeals portions of our constitution, and, in essence, 3. declares the constitution is unconstitutional. Yes, that is illogical, but that is precisely what Chief Justice Roberts and the radical right-wing block of justices did in Trump vs. United States. This ruling gives Donald Trump a blueprint to convert America into a banana republic. And Donald Trump is exactly the kind of day-one-dictator who will do it. This ruling not only excuses lawless conduct by a corrupt president, it endorses such conduct, and thereby encourages future presidents to act lawlessly and to direct others to to the same then simply exercise his core constitutional power of the presidential pardon to pardon all of his criminal associates who carry out his unlawful commands. This is not just absolute presidential power. It is absolute presidential power PLUS. And like Dred Scott, Korematsu, and Plessy vs. Ferguson, this opinion must not stand. In an opinion by Chief Justice John Roberts, the Supreme Court disregards the plain language of a law by which Congress criminalized conduct that "obstructs, influences, or impedes any official proceeding." Another of Donald Trump's criminal flunkies - Steve Bannon - is now headed to prison on July 1st, given the Supreme Court has rejected his request to delay the commencement of his 4-month prison term. Bannon was convicted on two counts of contempt of Congress for defying congressional subpoenas to testify and to provide documents about the January 6th attack on the US Capitol which was designed to keep Trump in power after he lost the 2020 presidential election. Another criminal Trump flunky, Peter Navarro, was also ordered to serve a 4-month prison term for committing the same crimes Bannon committed. But this may end up being the first of multiple prison terms for Bannon. He is pending trial in New York State court for defrauding Trump supporters out of their money with a fictitious "We Build The Wall" foundation. Recall, Bannon was indicted federally for the same fraudulent scheme, but Trump pardoned him right before he left office. . Judge Jaun Merchan modified the gag order he had placed on Donald Trump. The gag order no longer prohibits Trump from talking about witnesses and jurors in his case. However, it remains in effect to protect court staff, prosecutors and their staff, and their respective family members. Judge Aileen Cannon continues to give defendant Donald Trump - the very person who gave her her lifetime appointment as a federal judge - the delay he so covets. She continues to litigate frivolous motions that are forever being filed by Trump's attorneys, in an apparent attempt to delay Trump's federal prosecution in Florida as long as she can. Glenn discusses how judges nearly always set trial dates as a way to set intermediate deadlines for motions to be litigated and resolved: no trial date, no intermediate deadlines. It is becoming painfully obvious that delay IS the point of Judge Cannon's refusal to set a trial date. Glenn also discusses the fact that the normal practice in federal criminal cases is for judges to quickly and summarily deny motions without hearings when the defense can't meet its "burden of production" - the required showing that there is evidence and law supporting the motion they are filing. Judge Cannon continues to prove that her "impartiality might reasonably be questioned" - which is the legal standard for a judge being required to leave the case - in favor of having a fair, independent, and impartial judge to preside over the case.
